Dear Prof Chhokar,

Read your write-up and liked it immensely. The dedication and sincerity in cleansing the political system in India, is worth appreciation.

I however, feel, very few people, let alone Judges, know about the political system in India.

Essentially a republican democracy. Its my very strong believe based on my study and deep understanding of the Constitution of India and its making that "Political Parties (hereinafter PP for short)" have nothing to do with Elections and also with setting up candidates for Lok Sabha and Rajya Sabha.

At the maximum, I am ready to accept the PP's as opinion making bodies for citizens.

Its the citizen and citizen alone which has got the qualification to get into Lok Saha and Rajya Sabha as per the constitutional check and balance and certainly the PP's don't pass the muster on the constitutional touch-stone. Kindly refer to Art 84 (the Qualification for membership of Parliament), Art 99 (Oath or affirmation by members) & Art 100 (Voting in house, power of house to act notwithstanding vacancies and quorum).

The PP are not constitutionally allowed to exist and function inside the Parliament, notwithstanding the 10th Schedule of the Indian Constitution.

We must understand the system to fight the menace of political corruption and try to decriminalization the nation.

I am open for a debate with you. Let me know a time and place. Will be my honor!

Thanks,
Adv DN Tripathi

Mr P M Nair former Secretary to the President of India, Dr APJ Abdul Kalam in his book The Kalam Effect has narrated an incident in which a governor of a southern state had written to the President asking permission to visit Delhi to seek medical treatment.
This tells me that this practice or protocol has been in place for a very long time and this time government has just enforced what is written on paper.
You can argue the validity of a Victorian era protocol in which time leaving a state and returning would take months but it's enforcement should not be a matter of debate

The rules, including Constitutional ones, have to adapt to the changing times. To be true, Constitution clearly says Rajya Sabha isn't on equal pedestal as Lok Sabha because it doesn't have a say in Money Bills which includes the most important bill of the year: Budget.

But even going by your argument, Ambedkar might have given equal status in other matters to Rajya Sabha, but he couldn't even have dreamt that it will be peopled by the likes of Amar Singh or Sharad Yadav or Jaya Bachchan whose only claim to fame is they're unelectable and have money to buy a seat. If the author is that much worried about the exact interpretation of Constitution, how come he doesn't call for Uniform Civil Code or suspension of reservations which also have sound constitutional basis? What Jaitley has said is absolutely right: an unelected house which represents the elite cannot ride roughshod over the elected house which represents the aspirations of millions of people. If you disagree, please campaign to convert Rajya Sabha into an elected House of States like US Senate, and then ask for equal say.

A debate on media would do more good. However any initiative is good in this direction. What is relevant is that the dialogue is alive. Today there are six, tomorrow we can only expect the numbers to grow.

Bravo!
